“It is unfortunate that the detained crane operator faced inquest proceedings without legal counsel provided by either the contractor or the toll operator, when the fact of the matter is clear: he represented both entities when the steel girder collapsed and resulted in several casualties. For all intents and purposes, he was an agent of both EEI and SMC.”
Ridon, a lawyer, said criminal liability should not be borne by the crane operator alone.
“The entire on-duty construction team, including its project manager, minding the section of the collapsed steel girder should be made accountable for the incident, unless and until it can be shown that the mistake was the sole responsibility of the crane operator. The public should know that these activities are not undertaken by individual employees, but by entire construction teams.”
Ridon added that many questions relating to safety need to be addressed by the toll operator.
“They should explain why the area was not cordoned off, anticipating that these incidents could in fact happen. Further, they should explain why this type of construction activity had to be undertaken in broad daylight, with numerous vehicles and passersby going about their day.”
